Terms of Use
Last updated: 2026-10-27
Draft — not yet reviewed by a lawyer.
These terms govern your use of Marlo (the "Service"), operated by Manolo Wrolich ("we", "us"). By creating an account or using the Service you accept them.
1. What the Service is
Marlo is a study tool. You can import your own study material (photos, PDFs, Word files, presentations, text), turn it into flashcards and multiple-choice or written-answer questions, practise with spaced repetition, and take practice exams. Some features use artificial intelligence.
2. Beta status and availability
The Service is currently offered as a free beta. Features can change or be removed, and we do not guarantee uninterrupted or error-free availability. Please keep your own copy of material that matters to you; you can download all your data at any time under Account.
3. Who may use it
You must be at least 16 years old. Paid plans, if and when we offer them, are available to adults (18+) only. You must give a valid e-mail address, keep your password confidential and tell us if you suspect misuse of your account. You are responsible for activity under your account.
4. Your content and your rights
Your content stays yours. You give us a limited, non-exclusive licence to store, process and display it solely to run the Service for you (including, where you choose to use AI creation, sending the selected text to our AI provider). The licence ends when you delete the content or your account, subject to short technical backup cycles.
You promise that you have the right to upload and process the material you add and that doing so does not infringe copyright, licence terms, school or exam rules, or anyone's other rights. Do not upload material you are not allowed to copy or share, personal data of others, or special categories of personal data (such as health data).
Your decks are private. We do not publish or share them, and we do not use your content to train AI models.
5. Acceptable use
You agree not to:
- break the law or infringe the rights of others;
- attempt to access other users' data or to bypass security, limits or quotas;
- overload, scrape or reverse-engineer the Service, or use it to build a competing product;
- upload malware or content that is unlawful, abusive or harmful;
- use the AI feature to generate content that is unlawful or intended to deceive, e.g. to cheat on an exam in violation of your institution's rules.
6. AI-generated content
AI-generated questions and answers can be wrong, incomplete or misleading. Every generated question is tied to a quote from your material, but you must check it before relying on it. The Service is a learning aid. It is not professional, medical, legal or financial advice and does not guarantee any exam result. We are not affiliated with your school or any exam provider.
AI creation is limited by a fair-use allowance per month; the current allowance is shown in the app.
7. Fees
The free beta costs nothing. If we introduce paid plans, the price, billing period, renewal, cancellation and your right of withdrawal will be shown clearly before you buy, and these terms will be updated. Nothing is charged without your explicit action.
8. Termination and deletion
You can stop using the Service and delete your account at any time under Account; deletion removes your data as described in the Privacy Policy. We may suspend or end access if you seriously or repeatedly breach these terms, if required by law, or if we discontinue the Service (in that case we will give reasonable notice where possible so you can export your data).
9. Intellectual property of the Service
The software, design and name of the Service belong to us or our licensors. You may use them only as intended by these terms.
10. Copyright complaints
Your decks are private and not publicly accessible. If you believe that content stored in the Service infringes your rights, write to manolo@wrolich.com with a description of the work, where it is located in the Service and your contact details, and we will review the matter promptly.
11. Liability
We are liable without limitation for intent, gross negligence, injury to life, body or health, and wherever the law does not allow a limitation (including mandatory consumer protection law and product liability).
In other cases, and to the extent permitted by law, our liability for slight negligence is limited to foreseeable, typical damage and does not cover indirect damage or lost profit. We are not liable for loss of data that you could have avoided by exporting your data, or for exam results.
The Service is provided free of charge during the beta "as is" to the extent the law allows.
12. Changes to these terms
We may change these terms for good reason (for example new features, legal changes or security). We will tell you at least 30 days in advance by e-mail or in the app. If you do not agree, you can delete your account before the change takes effect; continued use after that date means you accept the new version. We will point this out in the notice.
13. Consumers, governing law and courts
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the mandatory consumer protections of the country where you live. If you are a consumer, you can sue or be sued at the courts of your place of residence or habitual abode. For businesses, the courts competent for Klagenfurt, Austria, have jurisdiction.
14. Languages and final provisions
These terms are provided in English and German. If they differ, the German version is authoritative for interpretation. Should a provision be invalid, the remaining provisions stay in force. Contact: manolo@wrolich.com.
